Spain taxes an individual's crypto gains as savings income on a progressive scale: 19% on the first 6,000 euros, 21% up to 50,000 euros, 23% up to 200,000 euros, 27% up to 300,000 euros and 30% above that. There is no relief for long holding.
Tax arises on any disposal, including a swap of one coin for another: the Spanish tax agency treats such a swap as a disposal with a gain or loss. Staking rewards are taxed on the same scale as capital income.
Who pays crypto tax in Spain
A Spanish tax resident is someone who spent more than 183 days in the country in a calendar year or has their centre of business or economic interests here. Someone whose spouse and minor children live in Spain is also presumed resident unless proven otherwise.
A resident pays tax on worldwide income, including sales of coins on foreign exchanges. A non-resident pays only on Spanish income.
The special regime for inbound specialists taxes them as non-residents, but it is chosen before moving and with a calculation, because its rules for capital income are different.
Russia suspended the main articles of its tax treaty with Spain from 8 August 2023, so the date of moving and the change of residency must be documented especially carefully. More on the Spain taxes page.
How to calculate crypto income
Tax is calculated on every sale and every swap: the euro value received on the deal date minus the purchase price and costs. Coins are disposed of first-in first-out: the earliest coins of the same kind are sold first.
The year's gain is added to other savings income and taxed on the 19% to 30% scale. A loss reduces gains of the same year, and an unused balance is carried forward for the next 4 years.
Paying for goods and services with crypto also counts as a sale. Every deal on a foreign platform must be valued in euros, so records are kept from day one.

In Spain every coin swap is taxed, and foreign holdings above 50,000 euros need a separate return
The usual mistakes are in three places: not treating a coin-to-coin swap as a sale, although Spain taxes it, mixing up the order in which coins are disposed of, and forgetting the information return on crypto held on foreign platforms. Mining and staking
Mining is taxed as a business activity on the general income tax scale: income minus electricity and equipment costs. A miner needs to register the activity.
Staking rewards are taxed as capital income on the 19% to 30% scale when received. Their value on the date received becomes the purchase price on a later sale.
If you are paid in crypto for your work or services, that is employment or business income on the ordinary scale, not a gain on selling coins.
Cashing out crypto and moving it to a bank
You can sell crypto for euros through platforms legally operating in the EU and withdraw the money to a Spanish bank account. The withdrawal itself is not taxed; the tax is calculated on the sale.
Spanish banks check incoming funds from exchanges under anti-money laundering rules and may ask for trade statements, the platform agreement and proof of where the first coins came from.
Banks do not accept deposits above 100,000 euros, about $112,100, from Russian citizens without EU residence, so a large withdrawal is planned together with the status.
Crypto account data sharing
From 1 January 2026 the EU directive on exchanging crypto-asset data applies: platforms collect data on clients' trades, and the first exchange between tax authorities takes place in 2027.
A Spanish resident holding more than 50,000 euros, about $57,000, in crypto on foreign platforms and with foreign custodians on 31 December files an information return between January and March of the following year. Large fortunes including crypto also count towards wealth tax under regional thresholds.
If sales and assets were not declared in past years, it is safer to correct them yourself before the tax office sends a request.
Licences for crypto companies in Spain
Companies that exchange, hold or transfer clients' crypto in the EU operate under a crypto-asset service provider authorisation under the EU Markets in Crypto-Assets Regulation. In Spain it is issued by the National Securities Market Commission.
