France taxes an individual's gain from selling crypto with the flat tax on capital income. From 2026 it rose from 30% to 31.4%: 12.8% income tax and 18.6% social contributions after one of them went up by 1.4 percentage points.
Tax arises when coins are sold for euros or used to pay for goods and services. Swapping one coin for another triggers no tax. If the total of all sales in the year is no more than 305 euros, about $350, the gain is exempt.
Who pays crypto tax in France
A French tax resident is someone whose main home or family is in France, who spends more than 183 days a year here, carries on their main professional activity here or has their centre of economic interests here. One of these conditions is enough.
A resident pays tax on worldwide income, including sales of coins on foreign exchanges, and declares foreign crypto accounts. A non-resident pays only on French income.
Instead of the flat tax a resident can choose the progressive income tax scale. It pays off with modest income, but the choice applies to all capital income for the year at once, so the decision is made with a calculation.
Russia suspended the main articles of its tax treaty with France from 8 August 2023, so the date of moving and the change of residency must be documented especially carefully. More on the France taxes page.
How to calculate crypto income
The gain is calculated not per coin but on the whole crypto portfolio: from the sale price you subtract the share of the total purchase price of all coins proportional to the share sold in the portfolio's value on the sale date.
A loss on a sale reduces crypto gains of the same year. It cannot be carried forward or set against other income.
A coin-to-coin swap, including into a stablecoin, triggers no tax, while paying for goods and services with crypto counts as a sale. A stablecoin is a cryptocurrency pegged to the dollar or the euro.
| Situation | Calculation | Tax |
|---|---|---|
| Bought coins for $10,000, sold the whole portfolio for $15,000 | $5,000 × 31.4% | $1,570 |
| Swapped a coin for another with a $3,000 gain | the swap is not taxed | $0 |
| All sales in the year total $300 | exempt within 305 euros | $0 |
| Portfolio bought for $10,000, worth $20,000, sold $5,000 | $5,000 - $10,000 × 5,000 / 20,000 = $2,500; × 31.4% | $785 |
| A $2,000 loss last year, a $6,000 gain this year | no carry-forward: $6,000 × 31.4% | $1,884 |

In France the gain is calculated on the whole portfolio, and each undeclared foreign account means a fine
The usual mistakes are in the formula and the reporting: calculating the gain on one coin instead of the share of the whole portfolio, paying tax on a coin-to-coin swap that is not taxable, and not declaring accounts on foreign exchanges, which carries a fine per account. We collect trades from all platforms, calculate the gain under the French formula, check whether the progressive scale pays off and complete the return with the foreign account annexes.
The cost of support depends on the number of trades and platforms; a manager will calculate it in the chat.
Mining and staking
Mining is taxed as income from a non-commercial professional activity on the general income tax scale, not at the flat rate.
If crypto trading is carried on as a professional activity, its income is also taxed on the general scale. Staking rewards are tracked from day one: their value when received matters both for tax and for the future purchase price.
If you are paid in crypto for your work or services, that is employment or business income on the ordinary scale, not a gain on selling coins.
Cashing out crypto and moving it to a bank
You can sell crypto for euros through platforms legally operating in the EU and withdraw the money to a French bank account. The withdrawal itself is not taxed; the tax is calculated on the sale.
French banks check incoming funds from exchanges under anti-money laundering rules and may ask for trade statements, the platform agreement and proof of where the first coins came from.
Banks do not accept deposits above 100,000 euros, about $112,100, from Russian citizens without EU residence, so a large withdrawal is planned together with the status.
Crypto account data sharing
From 1 January 2026 the EU directive on exchanging crypto-asset data applies: platforms collect data on clients' trades, and the first exchange between tax authorities takes place in 2027.
A French resident already declares every account on a foreign crypto platform opened, used or closed during the year. The fine for an undeclared account is about $850, or about $1,700 per account if the assets exceed 50,000 euros, about $57,000.
If sales and accounts were not declared in past years, it is safer to correct them yourself before the tax office sends a request.
Licences for crypto companies in France
Companies that exchange, hold or transfer clients' crypto in the EU operate under a crypto-asset service provider authorisation under the EU Markets in Crypto-Assets Regulation. In France it is issued by the Financial Markets Authority.
A French company's profit is subject to corporate tax, with a reduced rate for small businesses on the first part of profit. A comparison of countries for a licence is in our article on the crypto licence.
An international project without French clients often finds a licence in another country more convenient, and a French company is set up for a related business.
Murblz sets up crypto companies and licences in these services: crypto licence: countries and costs, crypto licence in Estonia, BVI company with a virtual asset service provider licence.
