Crypto tax in El Salvador in 2026
By law bitcoin exchanges are not subject to capital gains tax, and the 2025 reform kept this rule. Foreign income has been tax-free since 2024. What about other coins, how to become resident and how to get money into a bank.

El Salvador was the first country to make bitcoin legal tender in 2021, and the only one whose law expressly exempts bitcoin exchanges from capital gains tax. In January 2025, under an agreement with the International Monetary Fund, the law was amended: accepting bitcoin became voluntary and taxes are paid only in dollars. But the exemption remained.
Decree No. 199 of 29 January 2025 kept Article 5 of the Bitcoin Law: exchanges in bitcoin are not subject to capital gains tax. The articles on mandatory acceptance and paying taxes in bitcoin were repealed. Other coins have no separate relief and are taxed under the general rules.
Who pays crypto tax in El Salvador
A tax resident of El Salvador is someone who has lived in the country for more than 200 consecutive days in a calendar year. A resident pays income tax on Salvadoran income on a scale up to 30%.
Since 2024 income earned abroad has not been taxed in El Salvador, for residents or non-residents. So for a crypto holder the key question is where the income arises: profit on a foreign platform with a foreign counterparty counts as foreign.
A residence permit and citizenship do not create tax status. Since 31 March 2026 a temporary resident needs only 90 days in the country a year to keep the permit, but tax residence still requires 200 consecutive days.
How to calculate crypto income
Profit from exchanging bitcoin for dollars, goods or other assets is not subject to capital gains tax under Article 5 of the Bitcoin Law. It is still worth tracking: the bank and the tax authority will ask where the money came from.
Profit from other coins, such as ether or stablecoins, is not exempt under the Bitcoin Law. If the income is Salvadoran, it is taxed under the general income tax rules; if foreign, it has not been taxed since 2024.
Being paid in crypto for work or services in El Salvador is ordinary income on the scale, not a capital gain. Companies pay 30% corporate tax, or 25% if taxable income is up to $150,000 a year.

Bitcoin in El Salvador is exempt, but other coins and the bank need a calculation
Mistakes are mostly about the limits of the relief: any crypto income is assumed exempt although the Bitcoin Law covers only bitcoin, Salvadoran and foreign income are not distinguished, and people come to the bank without a wallet history. We sort income by coin and source, check what is exempt and prepare a source-of-funds package for the bank and, if needed, the investor programme.

Mining and staking
Mining in El Salvador is usually run through a company: its profit is subject to corporate tax, and electricity and equipment count as expenses. Separate incentive laws exist for projects with large technology investment; their conditions are checked before launch.
Coins received from staking or mining in bitcoin are not subject to capital gains tax when exchanged. Rewards in other coins are taxed under the general rules if the income is Salvadoran.
If you are paid in crypto for work or services, that is employment or business income and is taxed as ordinary income.
Cashing out crypto and moving it to a bank
El Salvador's national currency is the US dollar, so crypto can be sold straight for dollars and withdrawn to a local bank account without conversion.
Banks are cautious with crypto: transfers from exchanges get enhanced checks, and for large amounts you prepare the wallet history, exchange statements and tax returns from your previous country. Since 2025 businesses are not required to accept bitcoin, and the state wallet is being wound down.
For holders of large crypto capital with a transparent history the country offers an investor programme: a $1,000,000 contribution in bitcoin or a dollar stablecoin, residence and a fast track to a passport.
Crypto account data sharing
For a Salvadoran resident the main data exchange comes not from El Salvador but from the previous country and the exchanges. While you are tax resident elsewhere, that country taxes your crypto under its rules, and exchanges in the EU, the UK and other OECD-standard countries have been collecting client data for the country of residence since 2026.
So a move to El Salvador starts with ending tax residence in the previous country and documenting the date of the move.
Salvadoran banks ask for a client's tax residence and source of funds when opening an account, so documents on the change of residence are useful here too.
Licences for crypto companies in El Salvador
Companies providing bitcoin services register with El Salvador's Central Reserve Bank, and providers of services with other digital assets operate under a licence from the National Commission of Digital Assets.
An international project often finds a licence in Estonia or the British Virgin Islands more convenient, while a Salvadoran company is opened for local clients and the investor programme.
