Brazil taxes crypto profit as a capital gain, but with generous relief: if total sales in a month are no more than 35,000 reais, about $7,050, there is no tax at all. Above that, the profit is taxed on a progressive scale from 15% to 22.5%.
The government proposed a single 17.5% rate for all crypto transactions in 2025, but the provisional measure lapsed on 8 October 2025 without a vote in Congress. So the previous rules apply in 2026, and coins held or sold through foreign platforms are taxed separately.
Who pays crypto tax in Brazil
You become a Brazilian tax resident after 183 days in the country within 12 months or immediately on arrival with a permanent visa. A resident pays tax on worldwide income, including crypto on foreign exchanges and in self-custody wallets.
A non-resident pays tax only on Brazilian income. If you leave, Brazil expects an exit return and a departure notice: without them the tax authority keeps treating you as resident.

How to calculate crypto income
Tax is calculated separately for each month. First, the proceeds of all crypto sales on Brazilian platforms in the month are added up. If they are no more than 35,000 reais, the profit is exempt. If more, the whole month's profit is taxed, not just the part above the limit.
Profit is the sale price minus the average purchase price of coins of the same type. The rate depends on the size of the profit: 15% up to 5 million reais, 17.5% from 5 to 10 million, 20% from 10 to 30 million and 22.5% above. Tax is paid by the taxpayer by the last working day of the following month.
The tax authority treats both swapping one coin for another and paying for goods with crypto as a sale. Coins on foreign platforms count as foreign financial assets under Law 14.754/2023: the profit is taxed at 15% once a year in the annual return, with no monthly relief.

Crypto in Brazil means a 35,000-real monthly limit and separate rules for foreign exchanges
Mistakes are mostly about the limit and platforms: the 35,000-real relief is applied to profit instead of monthly sales, tax is not paid by the end of the following month, the monthly relief is applied to coins on a foreign exchange where it does not exist, and crypto is left out of the annual return. We sort trades by month and platform, calculate tax on the scale and at 15% for foreign assets, prepare the payment slips, the return and a package for the bank.

Mining and staking
Mining as an ongoing activity in Brazil is run through a sole proprietorship or company, and then business income is taxed under the chosen tax regime. Electricity and equipment count as business expenses.
Coins an individual receives from staking or mining are shown in the assets section of the annual return, and on sale the profit is calculated under the general capital gains rules.
If you are paid in crypto for work or services, that is ordinary income on the income tax scale, not a capital gain. It is best to track such receipts separately from day one.
Cashing out crypto and moving it to a bank
Crypto can be sold for reais through Brazilian platforms and the money withdrawn to a Brazilian bank account by instant payment. The withdrawal itself is not taxed; tax is calculated on the sale.
Brazilian banks check transfers from exchanges under anti-money-laundering rules. For large amounts, prepare trade statements, the exchange agreement and proof of where the first coins came from.
To sell coins through a Brazilian platform and open an account you need a Brazilian tax number. It is obtained at a consulate or the tax office before the move.
Crypto account data sharing
Since July 2026 a new monthly crypto transactions return has replaced the previous 2019 report. Brazilian platforms file it, and individuals do so if they use foreign platforms or transfer coins directly.
The new return follows the OECD crypto-asset reporting standard, so Brazil's tax authority will also receive information from foreign platforms.
In the annual return crypto is shown in the assets section at purchase cost if the value of coins of one type is at least 5,000 reais, about $1,010.
Licences for crypto companies in Brazil
Since 2 February 2026 companies that exchange, hold or transfer clients' crypto in Brazil operate under authorisation from the Central Bank of Brazil. The rules were set by central bank resolutions in 2025 under the 2022 virtual assets law.
An international project without Brazilian clients often finds a licence in another country more convenient, such as Estonia or the British Virgin Islands, while a Brazilian company is opened for the local market.
