Ecuador citizenship by birth for the child and the parents
Permanent residence for the parents at once for $225, their own passport no sooner than 3 years later. Ecuador makes a citizen of everyone born on its soil and lets the parents settle indefinitely straight away, but adults have to earn their own passport by living in the country, learning Spanish and passing an exam.

The short answer: yes, a child born in Ecuador becomes a citizen automatically, with no investment and no conditions on the parents' status. The parents get permanent residence right away, but a passport only through naturalization. Below: what it costs, how long it takes and where the route breaks down. If a baby is not part of the plan, all routes to an Ecuadorian passport are covered in a separate guide.
Does Ecuador give citizenship by birth
Yes, with no strings attached. Article 7 of Ecuador's 2008 Constitution makes everyone born on Ecuadorian soil an Ecuadorian by birth. The parents' passports, visas and days in the country before delivery are irrelevant: a tourist's baby and a local baby get the same status.
The rule survived the latest attempt to rewrite the constitution. On November 16, 2025, voters rejected all four questions in President Daniel Noboa's referendum, including a constituent assembly, so the constitution and birthright citizenship stand.
The same article reaches a generation further. Children born abroad to a mother or father who was born in Ecuador are also Ecuadorians by birth, and so are their descendants up to the third degree of kinship. Your child can pass citizenship on to descendants, even those who never visit.
Dual citizenship is allowed. Under Article 6 of the constitution, Ecuadorian nationality is not lost through marriage or by acquiring another nationality, and Article 8 expressly spares naturalized citizens from renouncing their original one.
| Who | What they get | When | Legal basis |
|---|---|---|---|
| The child | citizenship by birth, a cédula (national ID card) and a passport | status on the day of birth, documents after registration | Article 7 of the Constitution |
| Mother and father | residencia permanente - indefinite, that is permanent, residence as first-degree relatives of a citizen | application filed as soon as the child's documents are ready | Article 63 of the Organic Law on Human Mobility |
| The child's siblings | permanent residence as second-degree relatives or as minors dependent on a resident | together with the parents or right after | Article 63 of the Organic Law on Human Mobility |
| Grandparents | permanent residence as second-degree relatives | separate application, proof of means required | Article 63 of the Organic Law on Human Mobility |
| The parents | citizenship by naturalization | no earlier than 3 years of living in the country with permanent residence | Article 71 of the Organic Law on Human Mobility |
The Organic Law on Human Mobility is Ecuador's main immigration statute. It decides what the adults get, and here the news is less pleasant: a child's passport does not travel up the family tree.
We will estimate online the budget for your family: the birth and the child's documents.
Who Ecuador suits and who should pick another country
Ecuador's big advantage is speed for the parents: they get permanent residence straight away, with no temporary visa in between, for $225 in government fees. Paraguay offers no direct permanent residence through a child at all, and in Panama parents can only apply for residence through their child after the child turns five.
It suits families ready to spend at least three years in the Andes, who work remotely or run a business and want an affordable country. Ecuador uses the US dollar, so every figure here is in dollars, with no exchange-rate surprises.
It does not suit anyone who needs a strong passport for Europe: the Schengen area, the United Kingdom, the United States and Canada all require Ecuadorians to get a visa. Nor families who want to give birth and leave with passports for all: parents need three real years of residence, Spanish and an exam. Nor wealthy families who miss the special regime for newcomers: tax residents pay up to 37% on worldwide income. Nor anyone whose deciding factor is safety: in 2025 Ecuador set a grim record for homicides.
If none of these drawbacks stops you, Ecuador has a strength that rarely gets mentioned: the Andean migration statute gives its citizens the right to live and work in Colombia, Peru and Bolivia on nearly the same terms as locals.
Ecuador or its neighbors: where do parents get a passport faster
In all six countries below, the child becomes a citizen on the day of birth. The difference is how fast parents can stay and how long they wait for their own passport. Ecuador leads on the first and trails on passport strength. Passport strength here is measured by the number of destinations open without a visa obtained in advance.
| Country | Parents' status after the birth | Minimum time to parents' citizenship | Child's passport: visa-free destinations, 2026 | Main drawback |
|---|---|---|---|---|
| Ecuador | permanent residence at once, $225 in fees | 3 years with permanent residence | 92 destinations | no Schengen access, high crime on the coast |
| Brazil | residence through family reunification | from 1 year of residence | 170 destinations | Portuguese required, the clock starts when residence is registered |
| Argentina | temporary residence, permanent later | 2 years under Law 346 | 169 destinations | after Decree 366/2025 the naturalization procedure is being challenged in court |
| Uruguay | permanent residence by family tie, Law 19.254 | 3 years of living in the country | 156 destinations | leaving for more than 6 months in a row resets the clock |
| Paraguay | temporary residence first | 3 years after the permanent residence decision | 145 destinations | no direct permanent residence through the child |
| Panama | residence through the child only after the child turns five | 5 years after permanent residence | 147 destinations | naturalization requires renouncing the previous citizenship |
If the priority is legal status for the parents from the first months and low fees, Ecuador beats Paraguay and Panama. If it is a passport for visa-free travel to Europe, Brazil, Argentina and Uruguay open almost twice as many destinations. A detailed comparison of the routes is in our review of giving birth abroad for citizenship.
How much does it cost to give birth in Ecuador
A private maternity package in Guayaquil starts at $395, but that is the price of the room, not of the birth. Hospital Clínica San Francisco in the Kennedy Norte district publishes a natural birth package for $395 (one day in a private room and the delivery room for up to 2 hours) and a C-section package for $595 (two days in a room and the operating theater for up to 2 hours). Neither includes doctors' fees, tests, supplies or medicines, and both apply only to uncomplicated deliveries.
Major Quito hospitals such as Hospital Vozandes do not publish prices online. Budget for a private clinic and get written quotes from two or three: the package, the obstetrician, anesthesiologist and pediatrician itemized, plus a reserve for a C-section and neonatal intensive care.
Under Article 52 of the Organic Law on Human Mobility, public hospitals run by the Ministry of Public Health (MSP) cannot refuse emergency care because of a person's nationality or immigration status. That is an emergency safety net, not a birth plan.
Altitude or safety: a choice you will have to make
Quito sits at about 2,850 meters above sea level and Cuenca at about 2,560. Altitude is an obstetric factor in itself, so discuss it with your doctor before booking. Guayaquil is at sea level, but the coast is the most violent part of the country.
A family's official costs: a sample calculation
| Item | Amount | Comment |
|---|---|---|
| 90-day extension of the tourist stay | one third of the unified basic wage, ~$170 per person | The unified basic wage is the national minimum wage, $482 a month in 2026 |
| Birth registration | free | within the first 90 days after birth |
| Child's passport | $90 | fee of the Registro Civil, the state civil registry |
| Permanent residence, per parent | $225 | application review and visa issuance |
| Naturalization, per parent, after 3 years | $400 | according to the service page on the gob.ec portal |
| Apostilles and translations | depend on the country that issues the documents | criminal record certificates, marriage certificate |
Government fees before permanent residence for a couple who need the tourist extension start from $870. Flights, rent, the clinic and doctors come on top. Naturalization adds from $800 for the two of them after 3 years.
A birth from $395 in a clinic, but the child's passport is a separate procedure
Mistakes cost more than the clinic: a birth registration with wrong parent details, parents' documents without an apostille and translation, entry without a clear status that then blocks residence, missed deadlines for the child's passport. We choose the clinic and doctor, register the birth, obtain the child's passport and take the parents through to residence via the child.
The cost of support depends on the city, clinic and your family; a manager calculates it in the chat.
Stages and timelines: from the maternity ward to the child's passport
From maternity ward to passport takes a few weeks if the parents' paperwork is ready in advance. The bottleneck is almost always the tourist's permitted stay.
| Stage | What happens | Timing and cost |
|---|---|---|
| Preparation | choosing a clinic and getting a quote, criminal record certificates covering 5 years for every country of residence, marriage certificate; all apostilled and translated into Spanish | 1-3 months before departure |
| Entry | citizens of Russia, Ukraine, Belarus and Kazakhstan need no visa; a tourist may spend up to 90 days in the country per year from the first entry | on arrival |
| Extension | once, for up to 90 more consecutive days, on application to the Ministry of the Interior | one third of the unified basic wage, ~$170 |
| Birth | the clinic issues the informe estadístico de nacido vivo, the statistical live birth report on which registration is based | on the day of birth |
| Registration | the Registro Civil records the birth and assigns an NUI, the unique identification number | free; ordinary registration within the first 90 days |
| Cédula and passport | the ID card first, then the passport; for the passport both parents must attend or the absent one must give a power of attorney | passport $90; same-day issue in Quito, Guayaquil and Cuenca |
| Parents' permanent residence | online application through the e-VISAS platform of the Ministry of Foreign Affairs | $225 per person |
| Parents' citizenship | carta de naturalización, the naturalization certificate issued by the Ministry of Foreign Affairs | no earlier than 3 years with permanent residence |
From day 91, registration becomes extraordinaria, late registration, which is slower and needs extra evidence, so file in the first weeks. A birth without medical attendance requires a notarized statement with two witnesses, so a home birth complicates a simple procedure.
Unmarried fathers must acknowledge the child in person at the Registro Civil; otherwise the father is absent from the records and cannot apply for residence through the child.
The legal line. At the border, state the real purpose of your trip, give your real address and submit only genuine documents. A false address or sham residence leads to refused entry, cancelled status and criminal cases, not to time saved.
What documents you need: the full list
Before the flight, for each parent:
- a passport valid for at least 6 months;
- police certificates from your country of citizenship or from every country you lived in over the last 5 years, apostilled and translated into Spanish, issued no more than 180 days before your last entry to Ecuador;
- an apostilled and translated marriage certificate if you are married.
After the birth, for the child:
- the clinic's statistical report of a live birth, the basis for the civil registry entry;
- the birth record and the unique identification number, free within the first 90 days;
- an identity card and then a passport for 90 dollars: both parents must attend or give a power of attorney.
For the parents' permanent residence through the Foreign Ministry's online platform: a 5x5 cm colour photo, passport, police certificate, proof of means of support under Ministerial Agreement No. 70 of 28 June 2024, the child's Ecuadorian birth certificate and the marriage certificate. Fees: 50 dollars for review and 175 dollars for issue.
How do parents get permanent residence in Ecuador through their child
Unlike Paraguay or Panama, Ecuador gives a newborn citizen's parents indefinite status at once. Article 63(4) of the Organic Law on Human Mobility grants residencia permanente to relatives of an Ecuadorian citizen up to the second degree. Parents are first-degree relatives, so there is no temporary visa stage.
What you will need
- a 5x5 cm color photo on a white background in JPG format;
- a passport valid for at least 6 more months;
- a criminal record certificate from your country of citizenship or from every country you have lived in over the past 5 years, apostilled and translated; it must have been issued no more than 180 days before your last entry into Ecuador;
- proof of lawful means of support under Ministerial Agreement No. 70 of June 28, 2024;
- proof of the family tie: the child's Ecuadorian birth certificate and, if you are married, your marriage certificate.
Applications go online only, through e-VISAS; fees are $225. Over-65s pay half; people with a disability of 30% or more pay nothing. The visa never expires.
Under Article 64 of the Organic Law on Human Mobility, the sponsoring relative may prove the means of support. For grandparents and other second-degree relatives, Agreement No. 70 requires an extra $250 of proven monthly income per person on top of the basic means of support.
The main trap: time abroad
Permanent residence is not a license to leave. Under Article 65 of the Organic Law on Human Mobility, in the first two years a resident may spend no more than 180 days abroad per year, counted from the grant date; breaking the rule means an immigration fine. After that you can be away for up to two consecutive years; any longer and the residence is lost. Article 68 adds another ground: the visa is cancelled if a resident exceeds the permitted absence twice.
The amendment to the Organic Law on Human Mobility published on October 24, 2025, in Supplement No. 151 of the Official Register, tightened immigration control and sped up deportation. A family that follows the rules does not feel it, and violations get no leniency.
Before the birth there is no basis for residence through the child yet. To live in Ecuador in advance and choose a city at leisure, a separate residence permit helps, for example the Ecuador digital nomad visa for remote workers.

How many years until parents can get Ecuadorian citizenship
At least three, and the law offers no shortcut for parents of an Ecuadorian child. Under Article 71 of the Organic Law on Human Mobility, only people who have lived in the country with permanent residence for three years by the application date may apply for a carta de naturalización, the naturalization certificate. Article 73 grants a shorter two-year route only to spouses and registered partners of Ecuadorian citizens, and having a child is not on that list.
The residence must be real. The gob.ec service page is explicit: in the first three years with permanent residence, more than 180 days abroad in a year interrupts eligibility.
What gets checked
- age 18 or over and an apostilled birth certificate from your country of origin;
- spoken and written Spanish;
- knowledge of Ecuador's history, geography, culture and current affairs, tested in an exam;
- lawful means of support in the country and no debts to the state;
- an interview in which you explain why you want citizenship.
Graduates of Ecuadorian university and postgraduate programs taught in Spanish are exempt from the knowledge and language tests. Applicants over 65 skip the exam on the country but still need Spanish.
The gob.ec service page lists $400 in fees. After the decision, the new citizen has 45 days to obtain a cédula de ciudadanía, the citizen's ID card (Article 77.A of the Organic Law on Human Mobility). Ecuador does not require you to give up your Russian, Ukrainian or any other passport.
The uncomfortable truth about discretion
Article 77 of the Organic Law on Human Mobility calls the grant of a naturalization certificate a sovereign and discretionary act of the executive. Naturalization is at the discretion of the Ministry of Foreign Affairs, even for an applicant who meets every requirement. For parents, this is the route's main legal risk.
What an Ecuadorian passport gives you and where you still need a visa
In 2026 Ecuador's passport opens 92 destinations without a visa, with a visa on arrival or with an electronic travel authorization. For comparison, neighboring Colombia's passport opens 130 destinations and Peru's 141. The Ecuadorian document is solid for its region and weak for Europe.
What is open
Almost all of South America and much of Central America and the Caribbean. Russia, Ukraine, Belarus, Georgia, Armenia, Türkiye and Israel. In Asia, China, Hong Kong, Singapore, South Korea, Thailand, Malaysia, Indonesia, the Philippines and Kazakhstan.
What is closed
The Schengen area, the United Kingdom, the United States and Canada require a visa. So do several destinations that are often wrongly listed as visa-free: Mexico, Japan, Costa Rica, Cuba, the United Arab Emirates, Australia and New Zealand. A Schengen visa for an Ecuadorian citizen costs about $105 and goes through a consulate. If the goal is to travel freely around Europe, an Ecuadorian passport will not deliver it; you can compare documents in our 2026 passport ranking.
The trump card few people mention: the Andean statute
Ecuador belongs to the Andean Community (CAN) together with Bolivia, Colombia and Peru. The Community's Decision No. 878, the Andean Migration Statute, lets a citizen obtain temporary Andean residence in those countries for up to two years and then permanent residence. It lets you live and work, employed or self-employed, almost like a local. For a family thinking regionally, that beats a dozen beach destinations. For an overview of Colombia, see our Colombia page.
What taxes will you pay after moving to Ecuador
A family honestly building its three years of residence becomes tax resident in year one, and Ecuadorian tax residents pay up to 37% on worldwide income. The popular "5% tax, nothing on foreign income" claim is wrong. But a special regime for newcomers changes the math for many families.
Who becomes a tax resident
Under Article 4.1 of the Internal Tax Regime Law (LRTI), you are a resident if you spend 183 days or more in the country in a tax year, consecutively or not, or 183 days within 12 months spanning two tax years. The second test is the center of economic interests: main income or assets in Ecuador. Day counting is explained in our guide to tax residency and the 183-day rule.
The break: temporary tax residence for 5 years
Since December 20, 2023, the LRTI has included residencia fiscal temporal, a temporary tax residence regime. Anyone who has never been an Ecuadorian tax resident may pay tax for 5 years only on Ecuador-source income. One of two conditions applies: invest at least $150,000 in real estate or productive activities in the country and keep it there for at least 5 years, or prove at least $2,500 of monthly income from abroad and contribute to the Ecuadorian Social Security Institute, the state social security system. The condition must be met within 120 days of entry, so decide before the move.
Personal income tax brackets for 2026
| Annual taxable income, US dollars | Tax on the lower limit, US dollars | Rate on the excess |
|---|---|---|
| up to 12,208 | 0 | 0% |
| 12,208 - 15,549 | 0 | 5% |
| 15,549 - 20,188 | 167 | 10% |
| 20,188 - 26,700 | 631 | 12% |
| 26,700 - 35,136 | 1,412 | 15% |
| 35,136 - 46,575 | 2,678 | 20% |
| 46,575 - 62,005 | 4,965 | 25% |
| 62,005 - 82,679 | 8,823 | 30% |
| 82,679 - 109,956 | 15,025 | 35% |
| over 109,956 | 24,572 | 37% |
Tax paid abroad is credited, but only up to the Ecuadorian tax on the same income.
Tax on sending money abroad and on inheritance
The currency outflow tax is a tax on transferring money out of the country. Executive Decree No. 272 of December 30, 2025, kept the general 2026 rate at 5%; the reduced 2.5% and 0% rates cover certain productive sectors and pharmaceuticals, not individuals. Inheritances and gifts are taxed under a separate progressive regime in the LRTI.
Good news for the child: Ecuador taxes by residence, not citizenship, so an Ecuadorian living abroad files no Ecuadorian returns. Details are on our taxes in Ecuador page.
The pitfalls: safety, paperwork and time abroad
Safety. In 2025 Ecuador recorded 50.9 homicides per 100,000 inhabitants: a national record, up 31% in a year and second in Latin America only to Haiti. Since January 2024 the army has been deployed against criminal groups, with states of emergency in several provinces. Most of the violence is on the coast, above all in Guayas province around Guayaquil; the highland cities are calmer. The "safe Ecuador" of promotional copy is not today's reality.
Arriving late. The basic 90 days are tight if you fly in late in pregnancy. Apply for the 90-day extension before your stay runs out; an overstay is an immigration violation that damages your residence application.
Criminal record certificates. You need one for every country of residence in the past 5 years, apostilled and translated, and each must have been issued no more than 180 days before your last entry into Ecuador. Last-minute orders are the most common reason plans slip.
An unmarried father. Without a marriage certificate or an in-person acknowledgment of paternity at the Registro Civil, the father does not become the child's relative on paper and cannot get permanent residence through the child.
Spelling of names. The Ecuadorian certificate follows local rules for surname order and transliteration, so agree on the spelling with your passports at registration; corrections later cost more.
Traveling with the child. A minor Ecuadorian leaving with one parent needs the other parent's notarized consent. In a parental dispute this becomes a real problem, so for the current consent form ask an expert before traveling.
Counting on residence without living there. The 180-day limit and the discretion over naturalization break the "get the papers and leave" plan. Without living in Ecuador you get residence, not a passport.
Obligations to your own country. Under Russian law, a Russian citizen's child is also Russian, and the birth is registered at the consulate. Check your own country's rules on registration and reporting a second citizenship before the trip.

How we help with giving birth in Ecuador
We guide the family from document preparation to the citizenship application: we check the permanent residence file, arrange apostilles and translations, help with the child's registration, cédula and passport, and keep an eye on the rules for time abroad so the naturalization clock does not reset. We do not sell medical services: the clinic signs the birth contract with you directly. Legal representation before Ecuadorian authorities is handled by Murblz specialists together with partners licensed in Ecuador.
We start with a consultation: we work out a realistic budget, check whether you qualify for the special tax regime and tell you plainly if another country would serve you better. The Ecuador digital nomad visa lets you live in the country before deciding, a personal bank account in Ecuador covers banking, and translations and apostilles cover the paperwork. Everything about the country is on our Ecuador page, and other routes to a passport are in the second citizenship section.
