Poland has two permanent statuses, and both are loosely called permanent residence. The first is the permanent residence permit, granted through kinship and origin: to spouses of citizens, Pole's Card holders and people with Polish roots. The second is EU long-term resident status, earned through five years of legal residence, work and taxes.
Both statuses are indefinite, give the right to work without permits and lead to citizenship. From 2026 applications are filed only electronically through the Office for Foreigners' portal. The five years for long-term resident status count only legal residence: on a residence permit, with years on a study permit counted as half. Time under temporary protection and on seasonal work visas is not included.

Who can apply for permanent residence in Poland
EU long-term resident status is for a foreigner who has lived in Poland legally and continuously for at least 5 years and has stable income, health insurance, a right to housing and proven Polish. The ground may change over those years: work, your own company, family.
A permanent residence permit without the five years is granted through kinship and origin:
- to the spouse of a Polish citizen, after 3 years of marriage and 2 years on a marriage-based residence permit;
- to a Pole's Card holder or a person of Polish origin moving to Poland for good;
- to a child of a Polish citizen or of a foreigner with permanent status, in the parent's care.
The application is filed with the voivodeship office for your place of residence while you are legally in the country. Fingerprints are taken on filing, and a stamp is placed in the passport allowing you to stay in Poland until the decision.
Family members count their own time separately: a spouse and children who arrived later wait for their own five years. Children born in Poland to a parent with permanent status get it at once.
How residence time and absences are counted
Residence is continuous if no single absence lasted longer than 6 months and all absences over the 5 years did not exceed 10 months in total. For the spouse of a citizen the same limits apply to their two years. Business trips on the instruction of a Polish employer are not counted.
A change of ground does not interrupt the period if the new permit is obtained without a gap. The application for a new permit is filed before the old one expires: the waiting time with a stamp in the passport counts if the permit is eventually granted.
After the status is granted the rule is different. A permanent residence permit is withdrawn if you leave Poland for more than 6 years. Long-term resident status is withdrawn after 12 consecutive months outside the EU or 6 years outside Poland.
Documents for permanent residence in Poland
- an electronic application and photographs;
- a valid passport and residence card;
- documents on legal residence for the whole period: residence permit decisions, entry and exit stamps;
- tax returns for the last 3 years and proof of income: an employment contract or company documents;
- proof of health insurance;
- a right to housing: a lease or a title deed;
- a Polish language certificate or a diploma from a school or university taught in Polish;
- for spouses and Pole's Card holders, the marriage certificate or the card itself;
- the fee receipt.
Foreign documents are filed with a sworn translation. Income must be above the social assistance threshold for each family member and uninterrupted for all three years: a break in work without income is a common reason for refusal.
Language and exams
For EU long-term resident status Polish is mandatory: you need a state certificate at intermediate level or above, or a diploma from a Polish school or university taught in Polish. The state exam is held several times a year and registration closes quickly, so it is taken in advance. Children under 16 do not have to prove language skills.
There is no separate exam for a permanent residence permit based on marriage. The Pole's Card is obtained after an interview with a consul on Polish language, history and traditions. For citizenship everyone will need the certificate.

The fee is the same for both statuses: about $170 for the decision and about $30 for the card. The permanent residence card is replaced every 10 years and the long-term resident card every 5; the status itself is indefinite.
By law a decision is made within a few months, but in large voivodeships, especially Warsaw, processing in practice takes from six months to a year or more. All that time you stay in the country legally on the passport stamp.

Five years in Poland are wiped out by one gap in the paperwork or a month without income
The law does not stop you applying for permanent status on your own. But mistakes cost more than the fee: a gap between permits, one month abroad too many beyond the ten, a break in income over the last three years or a language exam you did not register for in time. We count your period and absences from your documents, check income against tax returns, plan the exam in advance and prepare the electronic application so the voivodeship does not send it back.

Why permanent residence is refused in Poland
- a gap in legal residence or absences longer than allowed;
- income below the threshold or with breaks over the last 3 years;
- no language certificate;
- no proven right to housing or health insurance;
- tax arrears;
- a marriage entered into for the permit: spouses are interviewed separately and cohabitation is checked;
- an entry in the list of undesirable persons or in the Schengen Information System.
A decision can be appealed to the Office for Foreigners, but that means months of waiting. So we check absences, income and documents before filing.

Permanent status suits those who live and work in Poland and do not plan to move to another EU country: for life in the country it is enough.

Restrictions for specific nationalities
Citizens of EU countries need neither a residence permit nor this status: after 5 years of living in Poland they acquire the right of permanent residence under the EU's simplified rules.
Special rules apply to citizens of Ukraine: time under temporary protection does not count towards the 5 years, so the route to permanent status is a switch to an ordinary residence permit.
Poland issues almost no new visas to Russian citizens, so starting the path from outside is hard; applications from those already living in the country legally are processed on the general terms but with longer security checks.
