Asylum in Uruguay: new permanent residency decree

8 min read ·

30,715 asylum claims are waiting for a decision, and only 52 Cubans have ever been recognized as refugees. A decree dated October 8, 2026 offers a way out: withdraw the claim and apply for permanent residency instead.

In short

  • What happened: on October 8, 2026 Uruguay approved permanent residency for asylum seekers who entered before January 1, 2026.
  • Who qualifies: people with a pending claim who withdraw it, and people with a final rejection.
  • Money: income above Uruguay's minimum wage, currently 25,383 pesos, about $630 a month.
  • Timing: the decree takes effect 90 days after official publication, with a 12-month filing window and one extension of up to 12 months.
  • Key benefit: home-country documents can be waived when they are impossible to obtain.

In detail

By the end of June 2026, 30,715 asylum claims were sitting unanswered in Uruguay. Cubans file almost 9 out of 10 of them, and only 52 Cubans have ever been granted refugee status: two in 2025, six in 2024. At that pace, the backlog would clear sometime next century. On October 8, 2026 the government admitted the obvious and opened a side door: withdraw the asylum claim and apply for permanent residency instead.

For people who arrived in Uruguay in recent years and got stuck between statuses, this is the most important immigration news of the year. Below: who qualifies, which documents you need, when filing opens and whether giving up asylum makes sense.

What did Uruguay decide?

The decree was signed by President Yamandú Orsi and Interior Minister Carlos Negro. It creates a special permanent residency based on ties to the country: a status for people who already live, work and pay contributions in Uruguay but are formally still asylum seekers.

The Refugee Commission cannot keep up, and the government itself calls it a structural mismatch between the number of claims and the agency's capacity. Net migration reached 14,959 people in 2025, up from 5,870 a year earlier, and most Cuban arrivals request asylum right at the border.

Uruguay has done this before. In May 2024, Decree 138/024 opened a similar path for about 20,000 people. By February 2025 more than 2,000 had applied, and over 90% qualified through work. That window has closed, so the new decree effectively reopens the door with a new arrival cutoff.

Who can apply for permanent residency under the new decree?

Foreigners of any nationality who entered Uruguay before January 1, 2026 and are in one of two situations.

SituationWhat to do
Asylum claim still pendingWithdraw it in writing when starting the residency process
Asylum finally rejectedApply for residency directly

General conditions for everyone:

  • you entered legally through an official border checkpoint;
  • you are not barred from entering or staying under the migration law;
  • you have no other ordinary ground for temporary or permanent residency.

The last point matters more than it looks. The decree is not a replacement for regular residency but an emergency exit for those who cannot use it. If you have another ground, immigration will send you down that road.

What documents and income do you need?

  • A photo for the file.
  • A valid identity document.
  • A criminal record certificate from any country where you lived more than 180 days in the 5 years before entering Uruguay.
  • Proof of income: your contribution history with Uruguay's Social Security Bank or a notary certificate of your work and monthly income.
  • A vaccination certificate under Uruguay's schedule.

Income must exceed the national minimum wage. Since July 1, 2026 that is 25,383 pesos a month, about $630. Household income of family members living in Uruguay also counts if you prove the relationship.

The most valuable clause concerns home-country documents. Immigration may waive them for well-founded reasons: the humanitarian situation at home, no consulate in Uruguay, prohibitive cost or no one back home to help. For people who cannot order papers from their own country, this is often the only way to become legal.

Children get a separate rule: in every case involving minors, the best interest of the child comes first.

When does filing open?

Not tomorrow. The decree takes effect 90 days after official publication, and by mid-October 2026 it had not yet appeared in the official gazette. If it is published in October, filing should open around January 2027.

From then you get 12 months to apply. The National Migration Directorate may extend that once by up to 12 months. When you start, you receive a certificate for a provisional ID as a resident in process, and after approval, the permanent document.

Approval is not automatic. Each case is reviewed individually, and incomplete documents or unproven income can lead to a refusal.

Should you give up your asylum claim?

For most people, yes. Uruguay recognizes so few refugees that the odds look more like a lottery than a procedure. Residency based on ties gives you what daily life requires: the right to work, open a bank account, rent a home and count the years toward citizenship.

The withdrawal is recorded in writing, an officer must explain the consequences, and the Refugee Commission is notified. The decree keeps the right to request asylum again later, but how that will work in practice is still unclear.

Who should not withdraw: people facing real persecution at home with a strong case. Refugee status protects against removal in ways ordinary residency does not. That decision belongs in a conversation with a lawyer, not in a queue at the immigration office.

What if you are not Cuban and filed for asylum anyway?

Many nationalities, including Russians, usually do not need this decree at all. They can enter visa-free for 90 days, apply for permanent residency inside the country and get an ID card before the decision. Details are in our guide to the Uruguay residence permit.

The decree helps when the regular path stalls:

  • you cannot obtain an apostilled criminal record certificate;
  • your passport has expired and your consulate is far away or unavailable;
  • you have income, but it is informal and needs a notary certificate.

If you already hold an ID as an asylum seeker, check which route is faster in your case. Sometimes it is smarter to file for regular residency now than to wait until January 2027.

How many years until Uruguayan citizenship?

Article 75 of Uruguay's Constitution grants citizenship after 3 years of residence with family and 5 years without. The Electoral Court decides, and it requires proof of permanent residency.

Hence an unpleasant detail: years spent as an asylum seeker do not always count the same way as years on permanent residency. If Uruguay is not the right fit

The neighbors have short routes of their own. Paraguay grants permanent residency right away with an investment from $70,000, and citizenship after 3 years: see Paraguay citizenship and Paraguay vs Uruguay. In Argentina the path to a passport takes 2 years of residence, see Argentine citizenship and Argentina vs Uruguay. All residency countries are in our residence permits abroad section, and passports in the second citizenship catalog.
