Serbia is convenient for buying: foreigners acquire apartments on a reciprocity basis, and owning a home gives a residence permit for up to 3 years with no minimum price. A mortgage is harder. Serbian banks are used to lending to residents with a local salary, and it is your status that decides whether you get a loan.

Hence the working order for a foreigner: first a residence permit and income in the country, then a mortgage on standard terms. Rates here are among the lowest in the region: the average on new housing loans is about 4.5% a year.

The average square metre in Belgrade costs about $3,700, so even with a 20% deposit you need substantial funds of your own: for a 50-square-metre apartment, about $38,000 plus transaction costs.

Housing loan rates in Serbia are mostly variable: the bank's margin plus six-month Euribor. For residents the margin starts at 2.9-3.1%; for non-residents it is raised, with 3.75 to 6.5% over Euribor as a guide.

For a bank, a resident is someone living in Serbia on a residence permit. A foreigner without one is a non-resident, even after years of visits and with an account here.

Besides a variable rate, banks offer a fixed one for the first years or the whole term: it is higher, but the payment does not rise with Euribor. The loan is denominated in euros with payments in dinars at the rate on the payment day, or in dinars with no currency link.

Income requirements and documents

The bank assesses permanent income: an open-ended employment contract, salary paid into an account over recent months, or a sole proprietor's income over 2 years. Income abroad is proven with an employer's letter, statements and a credit report from your country of residence.

Payments on all loans must not exceed half of income. The term is set so that the loan is repaid before the borrower's retirement age.

If one borrower's income is not enough, the bank counts a spouse's income as co-borrower. Sole proprietors and company owners are approved after two closed financial years in Serbia.

Documents for the application:

  • passport and residence permit, if you have one
  • employment contract and salary certificate, or a sole proprietor's accounts
  • bank statements for 6-12 months
  • a Serbian credit bureau report and a report from your country of residence
  • preliminary agreement and a cadastre extract for the apartment

Foreign documents are filed with a sworn translation. The apartment being bought serves as collateral; the bank requires a valuation and home insurance, plus life insurance for the borrower.

How a mortgage purchase works: steps

  1. Obtain a residence permit and open an account: with them the resident programmes become available.
  2. Get the bank's pre-approval on your income documents.
  3. Choose an apartment, check it in the cadastre and sign a preliminary agreement with a deposit.
  4. Order a valuation and get final approval of the amount.
  5. Sign the sale agreement and the mortgage statement at the notary and register the mortgage in the cadastre.
  6. The bank transfers the money to the seller and the buyer registers title.

From application to completion takes 4-8 weeks. A bank will not accept as collateral an apartment that is not registered in the cadastre in the seller's name.

The mortgage is set up as an out-of-court one: the notary certifies the mortgage statement and the bank registers the pledge in the real estate cadastre. Early repayment is allowed, with a fee of no more than 1% of the amount repaid.

On the resale market the buyer pays a transfer tax of 2.5% of the price. In a new build from a developer the price already includes 10% VAT and no transfer tax is due. First-home reliefs apply only to Serbian citizens.

The notary charges by a tariff that depends on the apartment's price; the valuation, home and life insurance and the cadastre fee for registering the mortgage are paid separately.

Does buying property give residency in Serbia

Yes. The Law on Foreigners names home ownership as a ground for a temporary residence permit, with no minimum price. The permit is issued for up to 3 years, and after 3 years of continuous residence you can apply for permanent residence.

The apartment must be registered in the cadastre in your name: a preliminary agreement does not qualify for a residence permit.

Restrictions for specific nationalities

Foreigners buy homes in Serbia on a reciprocity basis: if Serbian citizens may buy property in your country, you may buy in Serbia. Reciprocity is met for citizens of Russia, the European Union, the United States and most other countries.

Agricultural land is not sold to foreigners. Citizens of Russia, Belarus, Kazakhstan and China enter visa-free for 30 days; citizens of the European Union and the United States for 90 days.

You can also buy through a company registered in Serbia: the restrictions on foreign individuals do not apply to it, but the bank assesses a mortgage for such a company on its accounts.

The large Serbian banks belong to European groups and screen clients under their rules. Borrowers from sanctioned countries should prepare source-of-funds documents in advance; the bank makes the lending decision itself and does not have to explain a refusal.

The alternative: developer instalment plans

Developers in Belgrade and Novi Sad sell apartments in buildings under construction with staged payments: a first payment on signing and the rest as construction progresses. There is no interest, but the full amount must be paid by handover.

Such a plan is short, usually 1-2 years, and suits those who already have most of the money. Before signing, the building permit is checked, along with the seller's registration in the cadastre as the project's investor.

Banks also finance purchases in buildings under construction if the project is accredited: the deposit goes to the developer and the bank pays the rest in stages as construction progresses.
