After the reform of its Law on Foreigners, Serbia became one of the easiest countries for a family move. Temporary residence is granted for up to three years instead of one, permanent residence after three years, and adult family members get the right to work without a separate permit. Family reunification is one of the law's main grounds.
The sponsor can be a Serbian citizen or a foreigner who already holds a permit: through work, their own company, property or study. Marriage to a citizen of Serbia and marriage to a foreign resident
The law names three family grounds: a spouse of a Serbian citizen or of a foreigner with temporary or permanent residence, a common-law partner of such a person, and another member of their family. The immediate family covers spouses, common-law partners and their minor children, including adopted children and stepchildren.
The general conditions are the same for everyone: a valid passport, proof of means of subsistence, a registered address, health insurance and a paid fee. The differences between marriage to a citizen and marriage to a foreigner are in the table.

A common-law union is treated like marriage in Serbia but is harder to prove: documents showing life together are needed. A fiancé or fiancée gets no separate status, but foreigners can register a marriage in Serbia during a visa-free stay. After four years of residence on the family ground you can apply for autonomous residence, which no longer depends on the spouse.
Documents and legalising the marriage
The application is filed through the government portal for foreigners or in person at the police foreigners' office where you live. It must be filed while your lawful stay is valid: the visa-free period or a long-stay visa.
- passport and photograph;
- marriage certificate or documents proving a common-law union; birth certificates for children; foreign documents with an apostille and a court interpreter's translation;
- the Serbian citizen's ID or the main applicant's residence permit;
- proof of means of subsistence: a bank statement, employment contract or the sponsor's income certificate;
- proof of address: a lease or title deed and residence registration;
- health insurance and fee receipts.
A marriage concluded abroad is recognised on a certificate with an apostille and translation. Serbia has legal assistance treaties with a number of countries that simplify acceptance of documents, but a court interpreter's translation is needed in any case.
Children and the other parent's consent
Minor children receive family reunification permits together with the parent: biological and adopted children and stepchildren. Their permit is tied to the parent's term. After 18 a child needs a ground of their own: study, work or autonomous residence.
If a child moves with one parent, prepare the other parent's notarised consent to the child living in Serbia, with an apostille and translation, or a document that replaces it: a custody decision or a death certificate. Children with permits attend state schools; Belgrade also has international schools.
Residence for parents
Parents of adult children are not part of the immediate family under the law. Permits for other relatives are allowed only in exceptional cases with particularly justified reasons, for example when a parent needs care and there is no one else to provide it. Such cases are decided individually.
In practice it is easier for parents to obtain a ground of their own: a property-based permit after buying a flat or house in their own name, or a retiree permit with a confirmed pension. Both give the same term of up to three years and the same path to permanent residence.
How sham marriages are checked
The law expressly describes a marriage of convenience: one concluded solely to obtain residence. Signs the police look at: the spouses do not live together, do not know each other's personal details, share no common language, money was paid for the marriage, or one of them has had such marriages before. The police may check the address and interview the spouses separately.
If the marriage is found to be one of convenience, the permit is refused and one already issued is cancelled. That also closes the way to permanent residence and citizenship, so come to the check with real traces of a shared life: a common address, joint accounts, trips, photographs.

The whole process from filing to card usually takes 1-3 months. The first family reunification permit costs about $250 including filing and the card, or about $140 for a Serbian citizen's spouse. Permanent residence after three years costs about $230 including the foreigner's identity card.

Common reasons for refusal
- the application was filed after the lawful stay had ended;
- means of subsistence, address or health insurance not proven;
- certificates without an apostille or a court interpreter's translation, or mismatched names;
- the police found the marriage to be one of convenience: the spouses do not live together or give different answers;
- the main applicant's permit has expired or been cancelled;
- an entry ban, a criminal record or past breaches of migration rules.
Gaps between permits reset the clock for permanent residence, so file the extension before the old permit expires.
Restrictions for certain nationalities
Family reunification rules are the same for all foreigners; the differences concern entry and documents.
Russian citizens enter Serbia visa-free and may stay up to 30 days: the permit application has to be filed within that period. Citizens of Belarus and Kazakhstan also enter visa-free for a short period. Marriage and birth certificates issued in Russia are accepted with a court interpreter's translation.
Citizens of visa-required countries first need a long-stay visa. Serbia allows dual citizenship, so a Serbian citizen's spouse does not have to give up their previous passport when naturalising, if their own country permits it. A Serbian permit gives no right of entry to the Schengen Area: trips to the EU still require a visa.
