Investment property: Liberia

To be direct: Liberia is not a market for classic real estate investment from abroad.

Article 22 of the Constitution reserves land ownership for Liberian citizens: foreigners, individuals and foreign companies alike, cannot own land. The format available to them is a long-term land lease, used by businesses operating in the country for offices, warehouses, staff housing and production. The market is small and concentrated in Monrovia, liquidity is limited, and the title registration system is still being rebuilt.

If a foreigner is offered freehold land in Liberia, that is a warning sign: such a deal cannot be lawfully completed, and money will be hard to recover.

How a long-term lease is set up

  • Checking the lessor's title: the chain of land documents and whether there is a dispute, inheritance or customary claim.
  • A survey by a licensed surveyor and comparison with Liberia Land Authority records.
  • A lease drafted by a lawyer: term, rent, right to build, renewal and termination.
  • Probate of the lease at the Monthly and Probate Court of the county where the land lies: the judge reviews and certifies the document.
  • Registration of the lease with the national records registry, whose deeds functions are moving to the Liberia Land Authority.

Main risks

  • The same plot sold or leased to several buyers.
  • Forged or incomplete land documents.
  • Customary land rights recognised by the 2018 law that the lessee was not told about.
  • Boundaries that do not match registry records.
  • The lessor's real estate tax arrears.

So checks before signing matter more here than in most countries: we do not start a deal without verifying the document chain and the survey.

Who a land lease in Liberia makes sense for

A long-term lease is justified for companies already operating in or entering the country: mining and agriculture, logistics near the Freeport of Monrovia, construction, telecoms, international organisations and housing for their staff. If you build on leased land, agree in advance what happens to the buildings at the end of the term: a renewal right, buy-out of the buildings by the lessor or compensation. The lease term should exceed the building's payback period, otherwise the investment makes no sense. We set out these terms in the lease before it goes to court.

Money and payments

Liberia uses two currencies, the Liberian dollar and the US dollar, and large deals and rents are usually priced in US dollars. Payment is made through a bank after the lease is probated, not in cash before checks.

Residence and citizenship

Liberia has no residence or citizenship programme through buying or leasing property. A foreigner working in the country needs a visa, a work permit and residence through an employer or their own company.

What happens to buildings at the end of the lease?
The lease decides it: a renewal right, buy-out of the buildings by the lessor or compensation. Without such a clause the building on leased land goes to the landowner together with the plot.
