How a software developer from Asia got an O-1 visa in seven weeks
A working developer who thought the O-1 was only for famous founders got it approved in seven weeks, an RFE included. The case, the budget and the 2026 rules.
In short
- The client. A software developer from Asia who writes code and works on products and assumed the O-1 was only for famous founders and star engineers.
- The result. O-1 approved in 2026 in seven weeks, one request for evidence (RFE) included.
- The budget. $19,000 for the case, not including PR work; PR costs come on top.
- The file. Evidence from projects already done, strong recommendation letters and a complete petition. The rules ask for at least three of eight criteria and then weigh the whole file.
- The timing. Premium processing costs $2,965 and takes 15 business days; without it, 80% of O petitions finish within 14.5 months.
In detail
A software developer from Asia got an O-1 visa approved in 2026 in seven weeks, with one request for evidence (RFE) along the way and a case budget of $19,000, not including PR work. This is not a famous founder or a star engineer. It is a working developer who writes code, builds products and does the job well. The O-1 has no list of professions. It asks for documents that meet at least three of eight criteria and a file that persuades an officer you are at the top of your field.
"I honestly didn't think I had a chance," the developer says. "I always assumed the O-1 was only for famous startup founders or those superstar developers who everyone knows. I'm just a regular software developer - I write code, work on products, and do my job well, but nothing crazy."

What we saw in a regular developer's profile
When we looked at the profile, our answer was that an O-1 was realistic if the right things were presented the right way. That answer rests on how the rules work. On January 8, 2025, the US immigration service (USCIS) updated its O-1 guidance and added examples of evidence for people in critical and emerging technologies. Recognition that shows up in products, code and funding is now easier for an officer to read than it used to be.
These are the O-1 criteria that fit a developer's work best. Which of them carried this particular file stays between us and the client.
| Criterion | What it can look like for a developer | What does not count |
|---|---|---|
| Critical or essential role | Leading a function or a key project. A key committee or a high-performing team counts, and the organization does not have to be your direct employer. A startup's reputation can rest on significant funding from the government, venture funds or angel investors. | A grand title at an unknown company |
| Original contributions of major significance | Proven impact: adoption, licensing, citations, product revenue | A patent, funding or a publication on its own, with no trace of use |
| High salary | Pay clearly above peers in the same occupation and region, usually shown with wage surveys | Converting a foreign salary to dollars and comparing it with the American average |
| Published material about you | Articles about you and your work, with author, outlet and date. A piece about your team counts if it names you in connection with the work. | Paid articles, press releases, a passing mention in a list |
| Judging the work of others | Peer review, competition juries, grant and application panels | An invitation with no proof you actually reviewed anything |
Counting three criteria only opens the second step: the officer then weighs all the evidence together and decides whether you are at the top of your field. The USCIS manual warns that submitting the listed types of evidence does not, by itself, establish eligibility, so strong files clear four or five criteria and explain how the pieces connect. All eight criteria are on our page about O-1 visa requirements.
How the file came together
Nothing new had to be invented for this case. We helped the developer collect evidence from projects already done, obtained strong recommendation letters and put the whole petition together. "I was surprised how structured everything became," the developer says.
A petition also needs someone to file it. The regulation bars self-petitions, so a US employer, a US agent or your own company files Form I-129, and the file carries a written advisory opinion from a peer group or an expert in your field. Letters explain the evidence; they do not replace it.

The costly mistakes are filing on three weak criteria and never filing at all
A thin file ends in an RFE or a denial, and a denial stays on your record and comes up in later filings. The opposite mistake costs more quietly: a developer with a real case never checks it. Murblz maps your work against the eight criteria, tells you which are solid and where the evidence is thin, collects evidence from your projects, arranges the recommendation letters, prepares the whole petition and answers any RFE. The petition goes to USCIS with our partner, an American immigration attorney. We guarantee professional work and a transparent process.
The cost of support depends on your profile, who files the petition and how much evidence already exists; a manager will calculate it in the chat.
The RFE that did not end the case
The petition drew a request for evidence. We prepared the response and the O-1 was approved. "We got an RFE, but they handled the response and my O-1 was approved," the developer says.
An RFE is common and it is not a denial. From October 1, 2025 to June 30, 2026, USCIS made 23,417 decisions on O petitions and approved 91.0%. An RFE came in 5,678 of them (24.2%), and 3,793 of those 5,678 ended in approval. These figures combine O-1 and O-2, first filings and extensions, so 91% says little about the odds of a first-time applicant. What they do show is that one petition in four has to answer an officer's questions, and the answer decides the case.
How long an O-1 takes, and what seven weeks requires
Seven weeks covers the whole of this case, RFE included. A timeline like that is realistic only with premium processing: for $2,965, USCIS acts within 15 business days, and the count starts again once you respond to an RFE. Without it, 80% of O petitions finish within 14.5 months, and the number waiting for a decision rose from 6,712 in October 2025 to 8,925 at the end of June 2026.
An approved petition is not yet a visa. You apply at a US consulate in your country of nationality or residence, and you have to prove that residence. Under the State Department notice published on July 15, 2026, applying anywhere else makes it harder to qualify, the fee is not returned and the wait for an appointment is much longer.
What an O-1 visa costs in 2026
The overall budget for this case was $19,000, not including PR work; PR costs come on top. Government fees are public and the same for everyone:
| Fee | Standard | Employer with 25 or fewer staff |
|---|---|---|
| Form I-129 petition, on paper | $1,055 | $530 |
| Asylum Program Fee | $600 | $300 |
| Premium processing, optional | $2,965 | $2,965 |
| Consular visa fee | $205 | $205 |
| Total | $4,825 | $4,000 |
Filing online brings the standard petition fee down to $1,005. The $250 visa integrity fee set by the 2025 law is not on the State Department's official list of fees, so it is outside these totals.
What the visa gives you, by passport
For applicants from Asia, the same approval produces different visas. The visa never runs longer than the approved petition, which covers up to three years at first, with extensions of up to one year at a time.
- 60 months, multiple entries: India, Japan, South Korea, the Philippines, Thailand, Singapore, Malaysia, Taiwan, Hong Kong, Macau, Sri Lanka.
- 48 months: Pakistan.
- 36 months: Mongolia.
- 12 months: Indonesia, Vietnam, Bangladesh.
- Three months, single entry: mainland China, Cambodia.
Visa issuance is fully suspended for citizens of Afghanistan, Iran, Laos, Myanmar, Syria and Yemen. India, China, Japan, South Korea, Vietnam, the Philippines, Indonesia, Thailand, Singapore, Malaysia, Pakistan and Bangladesh are on neither of the two lists of restricted passports. A spouse on an O-3 visa can live and study in the USA but may not work. If the employer ends the job early, the employer and the petitioner jointly pay the reasonable cost of your trip home. Many holders use the O-1 as a bridge to permanent residence: our comparison of the US green card for talent sets it against the EB-1A and NIW.

If you have assumed this visa is not for you
This client started where many developers start: sure that the O-1 belongs to someone else. "I still can't quite believe it worked for someone like me," the developer says. "Really glad I tried."
You may have more to work with than you think. Projects you have already shipped, people who can speak to your work and a file built the right way carried this case to approval in seven weeks. Murblz reads your profile first and tells you plainly whether the file is ready, then takes it from the first document to the decision. More client stories are on our about page. Check my O-1 case
